Terms of Service

These Terms govern your use of www.hijack.co.in ("Hijack", "the Service"), operated by Jack Stephen Tucker, a sole proprietor in India, registered under Udyam registration number UDYAM-GA-0061593, with place of business at 179, Lane 2A, Alto Bella Vista, Sangolda, Porvorim, Bardez, Goa 403511, India ("we", "us"). "The Performer" means whichever independent performer — a musician, DJ or venue — is running the live performance you are attending through the Service.
By using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. What the Service is
Hijack is a platform that lets independent live performers take song requests from their audience during a live performance, and receive a fee for a request where a guest chooses to pay one. Each Performer uses the Service under a separate agreement with us (our Performer Agreement) and is an independent party, not our employee, agent, or partner — a Performer is solely responsible for their own performance.
Where you pay a fee for a request, that payment is collected by us and paid on to the Performer, less a service fee we retain for operating the Service — see Section 6. The fee shown to you at checkout is fixed at the time of payment and is not affected by how it is later divided between us and the Performer.
2. Eligibility
You must be 18 years of age or older to use the Service and to make any payment through it. By using the Service you confirm that you meet this requirement. We do not knowingly permit use of the Service by anyone under 18.
You must be physically present at a venue where the Performer is performing, during that performance, in order to submit a request.
3. What a song request is
A song request is a request that the Performer perform a specific song during a live performance. Requests may be submitted free of charge, or at one of several paid tiers listed on the Pricing page.
- Free request — submitted without payment, considered at the Performer's discretion after all paid requests.
- Paid request — submitted at one of the published tiers. Each tier includes the benefits of every tier below it, and is placed in the request queue ahead of all free requests.
Paid requests are ordered by the amount paid, highest first. A later, higher-tier request may therefore be placed ahead of an earlier, lower-tier one. Requests at the same tier are ordered by the time payment was confirmed.
Tiers may include additional benefits, which are stated against each tier on the Pricing page and may include your message being displayed publicly on the live set list, a spoken acknowledgement during the performance, a reply from the Performer, or eligibility to add a photograph to the venue display. The benefits attached to your request are fixed at the time of payment and are not affected by any later change to the published tiers.
Requests may include an optional message to the Performer.
4. What you receive, and what is not guaranteed
A request is a request, not a purchase of a guaranteed performance.
Submitting a request — including a paid request at any tier — does not guarantee that the song will be performed. The Performer may accept or decline any request for any reason, including:
- the song is not in the Performer's repertoire;
- the song is unsuitable for the venue, audience, or point in the set;
- the performance ends before the request is reached;
- the request contains offensive, discriminatory, harassing, or unlawful content;
- the venue or event organiser objects.

A paid request purchases a position in the request queue and the benefits stated for its tier. It does not purchase a guarantee of performance. Paid requests at every tier are subject to the same right of decline, and the same full refund on decline.
If a benefit stated for your tier cannot be provided — for example the performance ends before a spoken acknowledgement is given, or no display slots remain — that request is refunded in full on the same terms.
5. Fees
Fees for each request type are listed on our Pricing page. Fees are displayed in Indian Rupees (INR) and are inclusive of all applicable taxes. The fee shown at the point of payment is the fee you will be charged.
6. Payment
Payments are processed by Razorpay, a payment aggregator authorised by the Reserve Bank of India. We do not collect, store, or have access to your card number, UPI PIN, bank credentials, or any other payment authentication data.
Where you pay a fee for a request, that payment is collected into our own account with Razorpay. We retain a service fee from it and pay the remainder to the Performer's own linked bank account, through Razorpay's standard settlement process. This does not change what you are charged: the fee you pay at checkout is the same regardless of how it is later divided between us and the Performer.
7. Acceptable use
You agree not to:
- submit requests containing content that is unlawful, obscene, defamatory, harassing, discriminatory, or that infringes any third party's rights;
- submit requests that identify or target any individual without their consent;
- use the Service to advertise, solicit, or promote any product or service;
- attempt to interfere with, disrupt, reverse-engineer, or gain unauthorised access to the Service;
- submit automated or bulk requests.
We may decline any request, refund any payment, and restrict access to the Service where we reasonably believe these Terms have been breached.
8. Messages you submit
Messages submitted with a request may be displayed publicly on screens at the venue and on the Service's request queue. Do not submit anything you would not want displayed publicly. We may decline to display, or may edit or remove, any message at our discretion.
9. Intellectual property
The Hijack name, branding, interface, and software are owned by Jack Stephen Tucker. Song titles and recordings referenced in the Service remain the property of their respective rights holders. The Service does not distribute, stream, sell, or reproduce any musical recording. Public performance licensing at the venue is the responsibility of the venue and the Performer under applicable Indian law.
10. Availability
The Service is provided on an "as available" basis. It depends on network connectivity at the venue and on third-party payment infrastructure. We do not warrant uninterrupted or error-free operation. If the Service becomes unavailable after you have paid and your request cannot be performed, the fee is refunded in full.
11. Limitation of liability
To the maximum extent permitted under applicable Indian law, our total liability to you in connection with the Service is limited to the total amount you paid through the Service in the 12 months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability under the Consumer Protection Act, 2019.

We will acknowledge your complaint within 48 hours and aim to resolve it within 30 days.
13. Changes to these Terms
We may update these Terms. The current version is always available at this page with the "Last updated" date above. Continued use of the Service after a change constitutes acceptance of the updated Terms.
14. Governing law
These Terms are governed by the laws of India. The courts at Bardez, Goa have exclusive jurisdiction over any dispute arising from them.
