Terms of Service

↑ Back to topThese Terms govern your use of www.hijack.co.in ("Hijack", "the Service"), operated by Jack Stephen Tucker, a sole proprietor in India, registered under Udyam registration number UDYAM-GA-0061593, with place of business at 179, Lane 2A, Alto Bella Vista, Sangolda, Porvorim, Bardez, Goa 403511, India ("we", "us", "the Performer").
By using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. What the Service is
Hijack is operated by a single independent live-performance musician. It allows guests attending a live performance by the Performer to submit song requests, and to pay a service fee for a request where they choose to do so.
The Service is not a marketplace. It does not connect guests with third-party performers, does not process payments on behalf of any other person, and does not take a commission from any third party. All payments made through the Service are made directly to the Performer for the Performer's own services.
2. Eligibility
You must be 18 years of age or older to use the Service and to make any payment through it. By using the Service you confirm that you meet this requirement. We do not knowingly permit use of the Service by anyone under 18.
You must be physically present at a venue where the Performer is performing, during that performance, in order to submit a request.
3. What a song request is
A song request is a request that the Performer perform a specific song during a live performance. Requests may be submitted in three ways:
- Standard request — a request submitted with a service fee, placed in the request queue in the order received.
- Priority request — a request submitted with a higher service fee, placed ahead of standard requests in the queue.
- Free request — a request submitted without payment, considered at the Performer's discretion after paid requests.
Requests may include an optional message to the Performer.
4. What you receive, and what is not guaranteed
A request is a request, not a purchase of a guaranteed performance.
Submitting a request — including a paid or priority request — does not guarantee that the song will be performed. The Performer may accept or decline any request for any reason, including:
- the song is not in the Performer's repertoire;
- the song is unsuitable for the venue, audience, or point in the set;
- the performance ends before the request is reached;
- the request contains offensive, discriminatory, harassing, or unlawful content;
- the venue or event organiser objects.
If the Performer declines your request, the service fee is refunded in full. See our Refund and Cancellation Policy.
A priority request purchases a higher position in the request queue. It does not purchase a guarantee of performance. Priority requests are subject to the same right of decline, and the same full refund on decline.
5. Fees
Fees for each request type are listed on our Pricing page. Fees are displayed in Indian Rupees (INR) and are inclusive of all applicable taxes. The fee shown at the point of payment is the fee you will be charged.
6. Payment
Payments are processed by our payment provider, a payment aggregator authorised by the Reserve Bank of India. We do not collect, store, or have access to your card number, UPI PIN, bank credentials, or any other payment authentication data.
Funds are settled to the Performer's own bank account. We do not hold funds on behalf of any third party.
7. Acceptable use
You agree not to:
- submit requests containing content that is unlawful, obscene, defamatory, harassing, discriminatory, or that infringes any third party's rights;
- submit requests that identify or target any individual without their consent;
- use the Service to advertise, solicit, or promote any product or service;
- attempt to interfere with, disrupt, reverse-engineer, or gain unauthorised access to the Service;
- submit automated or bulk requests.
We may decline any request, refund any payment, and restrict access to the Service where we reasonably believe these Terms have been breached.
8. Messages you submit
Messages submitted with a request may be displayed publicly on screens at the venue and on the Service's request queue. Do not submit anything you would not want displayed publicly. We may decline to display, or may edit or remove, any message at our discretion.
9. Intellectual property
The Hijack name, branding, interface, and software are owned by Jack Stephen Tucker. Song titles and recordings referenced in the Service remain the property of their respective rights holders. The Service does not distribute, stream, sell, or reproduce any musical recording. Public performance licensing at the venue is the responsibility of the venue and the Performer under applicable Indian law.
10. Availability
The Service is provided on an "as available" basis. It depends on network connectivity at the venue and on third-party payment infrastructure. We do not warrant uninterrupted or error-free operation. If the Service becomes unavailable after you have paid and your request cannot be performed, the fee is refunded in full.
11. Limitation of liability
To the maximum extent permitted under applicable Indian law, our total liability to you in connection with the Service is limited to the total amount you paid through the Service in the 12 months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability under the Consumer Protection Act, 2019.

13. Changes to these Terms
We may update these Terms. The current version is always available at this page with the "Last updated" date above. Continued use of the Service after a change constitutes acceptance of the updated Terms.
14. Governing law
These Terms are governed by the laws of India. The courts at Bardez, Goa have exclusive jurisdiction over any dispute arising from them.

↑ Back to topThis policy explains what personal data Jack Stephen Tucker ("we", "us") collects through www.hijack.co.in ("Hijack"), why we collect it, and what rights you have over it.
We are the Data Fiduciary for this data under the Digital Personal Data Protection Act, 2023 (DPDP Act). Our contact details are at the end of this policy.
1. Our approach
Hijack is designed to collect as little personal data as possible. You do not need an account to use it. You do not need to give us your name, and we never see your payment credentials.

Payment data we do not collect
Payments are processed by our payment provider, a payment aggregator authorised by the Reserve Bank of India. Your card number, UPI PIN, bank credentials and other authentication data are collected and processed by them directly. We never receive or store them. We receive only a transaction reference, the amount, and whether the payment succeeded, failed, or was refunded.
3. Consent
We process your personal data on the basis of your consent, which you give when you submit a request. Before you submit, you will see a clear notice describing what data is collected and for what purpose.
You may withdraw your consent at any time by contacting us using the details below. Withdrawing consent is as easy as giving it. Withdrawal does not affect processing carried out before withdrawal, and we may retain data where we are legally required to (see Retention below).
Where your data is needed to complete a payment or refund already in progress, we will complete that transaction before deleting the associated records.
4. Purposes — and what we will not do
We use your data only to:
- display and manage your song request;
- process your payment and any refund;
- notify you of the outcome of your request;
- prevent fraud and abuse;
- comply with legal and tax obligations.
We do not sell your personal data. We do not share it with advertisers. We do not use it for behavioural advertising or profiling. We do not use it to train machine learning models.
5. Photographs on the Wall
The Wall is an optional feature. You are never required to use it, and nothing else about your request depends on it.
A photograph you post to the Wall is public and permanent. It is visible to anyone who opens this site, including people who have never attended a performance and people who were not present. It is not limited to the night you posted it, and it stays up after the performance ends.
Before you post
- Only post a photograph you took yourself, or that you have the right to post.
- If other people appear in the photograph, ask them first. By posting, you confirm that everyone identifiable in it is aware and has agreed to it appearing publicly.
- Do not post a photograph of anyone under 18.
- Do not post anything you would not be comfortable being seen indefinitely, by anyone.
Review before publication
Every photograph is reviewed by Jack Stephen Tucker before it appears. Submitting one does not guarantee publication, and a photograph may be declined or removed at any time without notice — for example if it shows someone who has not agreed to appear, or is otherwise unsuitable. If you edit a published post, it returns to review and is hidden again until re-approved.
Removing a photograph
You can ask us to take your photograph down at any time, and we will remove it from public view. Write to info@hijack.co.in. You do not have to give a reason. If you appear in someone else's photograph and did not agree to it, contact the same address and we will remove it — you do not need to have used this service yourself to make that request.
What we cannot undo
Because the Wall is public, we cannot control copies made by others while a photograph was visible — for example screenshots, or copies cached or indexed by search engines. Removing a photograph stops us from displaying it and deletes it from our storage, but it cannot retrieve copies already taken by third parties. Please take this into account before posting.

Requests and display names you submit may be shown publicly on screens at the venue and in the request queue visible to other guests. Do not include anything in a request or message that you do not want to be public.
7. Where data is stored
Your data is stored on servers located in Singapore. This is outside India. Under the Digital Personal Data Protection Act, 2023, personal data may be transferred outside India except to territories the Central Government has notified as restricted, and Singapore is not currently notified as restricted. Your rights under this policy apply in full regardless of where your data is stored. We do not receive or store card, UPI or bank credentials at all — those are handled by our payment provider.

After these periods, data is deleted or irreversibly anonymised.
9. Security
We protect your data with encryption in transit (HTTPS/TLS), encryption at rest, access controls limiting access to those who need it, and regular review of our systems. No system is perfectly secure, but we take reasonable safeguards as required under the DPDP Act. In the event of a personal data breach, we will notify the Data Protection Board of India and affected users as required by law.
10. Your rights
Under the DPDP Act, you have the right to:
- Access — obtain a summary of the personal data we hold about you and how it is processed;
- Correction — have inaccurate or incomplete data corrected or completed;
- Erasure — have your data deleted, unless we are legally required to retain it;
- Nominate — nominate another person to exercise these rights on your behalf in the event of your death or incapacity;
- Grievance redressal — raise a complaint with us and receive a response.

If you are not satisfied with our response, you may escalate your complaint to the Data Protection Board of India.
11. Children
The Service is intended for adults aged 18 and over. We do not knowingly collect personal data from children. If we become aware that we have collected data from a person under 18, we will delete it. We do not carry out tracking, behavioural monitoring, or targeted advertising directed at children.
12. Cookies and similar technologies
We use only what is necessary to operate the Service: a session identifier to keep your request associated with your device during a performance. We do not use advertising or cross-site tracking cookies.
13. Changes to this policy
We may update this policy. The current version is always available at this page with the "Last updated" date above. Where changes are significant, we will make them prominent before they take effect.

Refund and Cancellation Policy

Summary
If your song request is not performed, you get your money back in full. Automatically. Every time.
You do not need to ask, file a claim, or contact us. The refund is triggered by the system the moment a request is declined or the performance ends without it being played.
1. When you are entitled to a full refund
You receive an automatic full refund of your service fee in each of the following cases:

This applies equally to standard requests and priority requests. A priority request buys a higher position in the queue, not a guarantee of performance — so if a priority request is declined or not reached, it is refunded in full on the same terms.
2. When a refund is not due
A refund is not due once the Performer has performed the requested song. At that point the service has been delivered.
Requests submitted using the free option involve no payment and therefore no refund.
We may decline to refund, and may restrict access to the Service, where a payment is found to be fraudulent or in breach of our Terms of Service.
3. Cancelling a request
You may cancel a paid request at any time before the Performer has accepted it, from the request queue screen. A cancelled request is refunded in full and automatically.
Once the Performer has accepted a request, it can no longer be cancelled, because the Performer has committed to performing it.
4. How and when refunds are paid
Refunds are initiated automatically within 24 hours of the triggering event. No action is required from you.
Refunds are returned to the original payment method used. We cannot refund to a different account, card, or UPI ID.
Once initiated, the time for the money to reach you depends on your bank or payment provider:

These timelines are set by your bank and the payment network, not by us. Our part — initiating the refund — is complete within 24 hours.
5. Amount refunded
Refunds are always for the full amount you paid. We do not deduct processing fees, service charges, or any other amount from a refund.
6. Currency
All payments and refunds are made in Indian Rupees (INR).
7. If your refund has not arrived
If a refund has not reached you within 10 working days of the request being declined, contact us with the date and amount of the transaction and, if you have it, the transaction reference:

9. Your statutory rights
Nothing in this policy limits your rights under the Consumer Protection Act, 2019 or any other applicable Indian law.

What you're paying for
You are paying for a song request to be placed in the queue for a live performance, and considered by the performer.
A request is not a guarantee that the song will be played. The performer may decline any request — because it isn't in the repertoire, doesn't suit the room, or the set ends first.
If a request is declined, the fee is refunded in full, automatically. You don't have to ask. See the Refund and Cancellation Policy.
A priority request buys a better position in the queue. It does not buy a guarantee, and it is refunded in full on the same terms if it isn't played.

No hidden charges
The price shown when you submit a request is the price you pay. There are no booking fees, convenience fees, or hidden charges added at checkout. There is no subscription and no account required.
